Compliance

Every call passes the same checks before it is placed: calling hours in the lead's local time, your do-not-call list, consent and state call limits. During the call we enforce the ring time, the abandonment cap and recording consent. A call that fails a check is never dialed, and you get a call.blocked event with the rule.

Calling hours

Calling hours use the lead's local time, from their state and area code. The default window is Monday to Saturday, 8 am to 9 pm, with Sunday closed. We keep the rules for the 22 states that are stricter than that, including state holidays when calls are not allowed. A lead with no state is never dialed automatically.

Pennsylvania allows sales calls only from 9 am to 7 pm, Monday to Saturday, and never on Sundays or state legal holidays. Connecticut allows 9 am to 8 pm. Florida, Oklahoma, Maryland, Washington and Oregon end at 8 pm.

These are examples. The full list is available from GET /v1/compliance_settings/calling_hours. You can narrow the window for your account, and you cannot widen it past the state rule.

Do-not-call list

Each account and subaccount has its own internal do-not-call list, checked before every dial and every message. Numbers are added through the API, when a lead presses the opt-out key, when they ask on a call not to be called again, and when they reply STOP to a text. Each addition sends dnc.added with the source.

Do Not Call Registry

Sales calls to consumers are checked against the National Do Not Call Registry using your own subscription. Each business needs its own subscription, and a subaccount cannot use its parent's. We download the registry with your subscription number at least every 31 days.

State do-not-call lists are checked when you hold them. Subscribe to each state, then upload each release with POST /v1/dnc_lists. See state lists.

A lead on the registry can still get a sales call when you have a signed written agreement with the person, or an established business relationship: a purchase or transaction in the last 18 months, or an inquiry in the last 3 months (47 CFR 64.1200(c)(2) and (f)(5)). Mark the lead with registry_exception. We stop applying a relationship exception when it expires or the person asks not to be called. State lists use their own exceptions. See registry exceptions.

Call limits

Florida, Oklahoma and Maryland allow 3 sales calls to a person in 24 hours, from any of your numbers. Oregon allows 3 unless the person is a customer. Debt collection accounts can turn on the 7 calls in 7 days limit. These limits apply across all numbers in the subaccount, and each lead keeps seeing the same number.

Ring time

Every line rings for at least 15 seconds or 4 rings before it is dropped, as 47 CFR 64.1200(a)(6) requires. This applies to every leg of a dial session, including the ones canceled after another line is bridged.

Abandonment cap

A call is abandoned when a person answers and no agent is connected within 2 seconds of the end of their greeting. 47 CFR 64.1200(a)(7) limits abandoned calls to 3% of answered calls per campaign, measured over 30 days. We track the abandoned-call rate for each campaign and lower the lines per agent as it nears 3%. At 3%, the campaign dials one line per agent until the 30-day rate is back under the cap. Dialing does not stop. You get compliance.cap_reached and an email with the numbers.

An abandoned call plays your identified message within 2 seconds. It gives your business name and a callback number, and offers a press-1 opt-out that adds the number to your do-not-call list.

Store the consent you collected for each lead: the type, when and where it was captured, and the exact text the person agreed to. With require_consent on, leads without a consent record are blocked. Records are kept with the call history and can be exported.

Recording consent

These 14 states require every party to agree before a call is recorded:

CA, CT, DE, FL, IL, MD, MA, MI, MT, NV, NH, OR, PA, WA

When the lead is in one of these states, or the state is unknown, Smart Recording records only the agent's side until the lead gives consent. In every other state both sides are recorded from the bridge. The statutes and notes for each state are in Recording.

Recorded and artificial voice

A recorded or artificial voice in a sales call needs the person's prior express written consent. That includes AI voices, voicemail drops and recorded clips an agent plays. Accounts turn this on only after review. Washington bans it for sales calls. The abandoned-call message is the only recorded message allowed by default.

Mark this consent on the lead's consent record with recorded_voice: true, next to the exact consent text, the source and the time it was given (POST /v1/consents). The call screener line and the recorded consent announcement for Smart Recording play only for leads whose consent record has it, and never on calls to Washington numbers. Without it the agent handles the call live.

Phone tree navigation

Federal rules restrict calls that use an artificial or prerecorded voice to reach a person without consent (47 U.S.C. 227(b) and 47 CFR 64.1200(a)(1) to (3)). Phone tree navigation is set up to stay outside that case. Its key presses and spoken options go only to automated phone systems. As soon as detection hears a live person, the navigator stops and the person is connected to your live agent. Apart from the screener option below, a person on the call never hears the navigator, and no recorded message is left on voicemail.

The call screener option is different. Its line is played to an automated screener, but the screener can pass the words on to the person as a transcript or as audio. We treat it as a recorded message. It plays only when the lead's consent record has recorded_voice: true, and never on calls to Washington numbers. Otherwise the agent is connected straight to the screener. The line is the agent's own recording and says who is calling, the business, why and a callback number, with no sales pitch.

Navigation is meant for business main lines. The usual consent and do-not-call checks run before the call is placed, the same as for any other call. This is our reading of the rules, not legal advice.

Your part

Liveleg runs the checks on this page on every call. You are the seller or the caller. You are responsible for consent, your registry subscription, state registrations, your lead sources, your scripts and what your agents say. If a carrier, a regulator or the industry traceback group asks about a call, we answer from your account's records and tell you.
